Can all Trade Marks be registered?
Not all trade marks can be registered. For a trade mark to be registered, it must be capable of distinguishing products or services of one trader from the same or similar products or services of other traders. Trade marks that indicate the kind, quality, intended purpose or value of the goods or services; or are common surnames or geographical names, are usually not capable of distinguishing products or services and therefore, are not capable of registration. If you use a trade mark that has already been registered by someone else, you may potentially subject yourself to infringement proceedings and the risk of significant damages. |
